Magazinul online Breeze Romania este detinut de societatea F INTERNET GLOBAL SRL cu sediul in str. Bodoc, nr. 8, sector 4, Bucuresti, Romania, avand numarul de ordine in Registrul Comertului
RC J40/4762/06.04.2017, CUI RO37343440 (“Endov”). Acesti termeni si conditii se vor aplica tuturor vanzarilor de bunuri de catre Endov, prin magazinul online Breeze Romania, catre cumparatori.
1. Utilizarea site-ului Utilizarea site-ului eczaciblog.online este gratuita si implica acceptarea termenilor si conditiilor mentionate in sectiunile site-ului. Te rugam sa citesti acesti termeni cu atentie si daca nu esti de acord cu acestia, te rugam sa nu folositi site-ul nostru.
Ne rezervam dreptul de a aduce modificari in orice moment site-ului nostru, fara nicio alta notificare. Ne rezervam dreptul de a modifica, edita, sterge, suspenda sau intrerupe, temporar sau permanent, site-ul nostru si/sau informatiile, materialele, produsele si/sau serviciile disponibile prin acesta. Iti recomandam sa recitesti in mod regulat termenii si conditiile pentru a fi informat in orice moment cu privire la modificarile aduse.
Endov este titularul drepturilor de proprietate intelectuala, designului si continutului site-ului precum si asupra marcilor inregistrate publicate pe site.
Utilizatorul este persoana care acceseaza site-ul, in scopuri private si care a acceptat termenii si conditiile acestuia. Este interzisa utilizarea abuziva a site-ului. Utilizarea abuziva este utilizarea site-ului cu incalcarea dispozitiilor legale in domeniu si care are ca efect prejudicierea detinatorului eczaciblog.online.
Endov nu este responsabil pentru prejudiciile create de erorile sau neactualizarea informatiilor publicate sau mentinute pe site, care nu se datoreaza culpei sale. Endov nu raspunde de nicio pierdere, cost, pretentie sau cheltuiala in cazul in care acestea sunt cauzate de nerespectarea de catre utilizator a termenilor si conditiilor site-ului.
2. Produse Produsele comercializare sunt noi si in momentul livrarii, sunt insotite de factura fiscala.
Imaginile sunt prezentate pe site cu titlu de exemplu.
Preturile afisate pe site sunt exprimate in lei si includ TVA. Preturile afisate pe site pot fi schimbate fara notificare prealabila. Daca insa comanda cumparatorului a fost confirmata, atunci pretul nu va suferi modificari.
La pretul produsului comandat se vor adauga costurile suplimentare de transport, de livrare, taxele postale sau similare. Promotiile prezentate pe site sunt valabile in perioada de timp mentionata sau in cazul in care nu se mentioneaza o perioada de timp, acestea sunt valabile in limitele stocurilor disponibile.
3. Comanda produselor Cumparatorul poate efectua comanda pe site sau telefonic la numarul La finalizarea comenzii, acesta trebuie sa confirme ca datele furnizate sunt corecte si complete la data plasarii comenzii.
Endov va transmite cumparatorului o confirmare electronica a comenzii la adresa de e-mail indicata. O comanda neconfirmata nu creeaza obligatii in sarcina Endov.
4. Garantia legala de conformitate Produsele noastre beneficiaza de garantie de conformitate conform dispozitiilor legale aplicabile, de 30 de zile de la data livrarii produsului.
Cumparatorul are urmatoarele drepturi,
conform Legii nr. 449/2003:
"Art. 9 - Vanzatorul este raspunzator fata
de consumator pentru orice lipsa a conformitatii existenta la momentul cand au fost livrate produsele.
Art. 10 - In cazul lipsei conformitatii, consumatorul are dreptul de a solicita vanzatorului sa i se aduca produsul la conformitate, fara plata, prin reparare sau inlocuire, conform art. 11, sau sa beneficieze de reducerea corespunzatoare a pretului ori de rezolutiunea contractului privind acest produs, in conditiile art. 13 si 14.
Art. 11 - (1) In cazul lipsei conformitatii, consumatorul are dreptul de a solicita vanzatorului in primul rand repararea produsului sau are dreptul de a solicita inlocuirea produsului, in fiecare caz fara plata, cu exceptia situatiei in care masura este imposibila sau disproportionata. (2) O masura reparatorie va fi considerata ca disproportionata, daca ea impune vanzatorului costuri care sunt nerezonabile in comparatie cu cealalta masura reparatorie, luandu-se in considerare:
- valoarea pe care ar fi avut-o produsele daca nu ar fi existat lipsa de conformitate; - importanta lipsei de conformitate; - daca cealalta masura reparatorie ar putea fi realizata fara un inconvenient semnificativ pentru consumator.
(3) O masura reparatorie va fi considerata ca imposibila daca vanzatorul nu poate asigura produse identice pentru inlocuire sau piese de schimb pentru reparare, inclusiv ca urmare a lipsei utilajelor sau a tehnologiei aferente.
(4) Orice reparare sau inlocuire a produselor va fi facuta in cadrul unei perioade rezonabile de timp, stabilita de comun acord, in scris, intre vanzator si consumator, luandu-se in considerare natura produselor si scopul pentru care acesta a solicitat produsele. Perioada de timp stabilita nu poate depasi 15 zile calendaristice de la data la care cumparatorul, dupa caz, a adus la cunostinta vanzatorului lipsa de conformitate a produsului sau a predate produsul vanzatorului ori persoanei desemnate de acesta pe baza unui document de predare-preluare.
(5) In cazul repararii produsului, in acesta vor fi montate numai piese noi.
(6) Vanzatorul are aceleasi obligatii pentru produsul inlocuit ca si pentru produsul vandut initial.
Art. 12 - Notiunea fara plata, prevazuta la
art. 10 si 11, se refera la toate costurile
necesare aducerii produselor la conformitate, inclusiv costurile postale, de transport, manipulare, diagnosticare, expertizare, demontare, montare, manopera, materiale utilizate si ambalare.
Art. 13 - Consumatorul poate solicita o reducere corespunzatoare a pretului sau rezolutiunea contractului in oricare dintre urmatoarele cazuri: - daca nu beneficiaza nici de repararea, nici de inlocuirea produsului; - daca vanzatorul nu a luat masura reparatorie intr-o perioada de timp rezonabila; - daca vanzatorul nu a luat masura reparatorie, conform art. 11 alin. (4), fara inconveniente semnificative pentru consumator.
Art. 14 - Consumatorul nu este indreptatit sa solicite rezolutiunea contractului, daca lipsa conformitatii este minora."
5. Plata Plata se poate efectua prin urmatoarele metode: in numerar (ramburs) – plata se face la primirea coletului. Comanda se achita integral, in lei, la livrarea efectuata de catre curier.
6. Livrarea Livram numai in Romania, prin intermediul firmelor de curierat rapid contractate. Costul livrarii este de 20 de lei (TVA inclus) si va fi suportat de cumparator. In cazul in care curierul va majora tariful de livrare, vom modifica acest pret si vom informa cumparatorii. Majorarea de pret este aplicabila tuturor livrarilor expediate dupa anuntarea majorarii.
Livrarea se efectueaza in termen de 2 zile lucratoare de la data confirmarii comenzii. Cheltuielile de transport sunt in sarcina cumparatorului.
Comenzile a caror valoare depaseste _____ Lei vor fi livrate gratuit in toata tara. Programul de livrare al comenzilor este de luni pana vineri, intre orele _________. Nu se fac livrari sambata, duminica si in zilele de sarbatori legale. Daca nu esti acasa in perioada respectiva, te rugam sa specifici adresa unde te putem gasi in acest interval orar.
Riscul de pierdere sau de deteriorare a produselor este transferat cumparatorului in momentul in care acesta sau o parte terta desemnata de acesta, alta decat transportatorul, intra in posesia fizica a produselor comandate.
7. Dreptul de retragere Cumparatorul are dreptul ca in termen de 14 zile de la primirea coletului sa informeze Endov cu privire la retragerea din contract si sa returneze produsele, fara a prezenta un motiv pentru decizia de retragere. Totusi, va trebui sa suporte urmatoarele costuri:
- costurile suplimentare in cazul in care a ales in mod explicit un alt tip de livrare decat livrarea standard oferita de Endov; - costul direct legat de returnarea produselor.
De asemenea, cumparatorul este responsabil si in ceea ce priveste diminuarea valorii produselor rezultata din manipularea acestora, diferit de ceea ce este necesar pentru determinarea naturii, caracteristicilor si functionarii produselor, in conformitate cu dispozitiile OUG 34/2014. Cumparatorul isi poate exercita dreptul de retragere prin una din urmatoarele modalitati:
- completarea si transmiterea formularului de retragere la adresa:
[email protected] ;
- transmiterea unei declaratii neechivoce (scrisoare trimisa prin posta, fax sau e-mail) catre Endov prin care isi exprima decizia de retragere din contract. Cumparatorul trebuie sa returneze produsele catre Endov inainte de expirarea perioadei de 14 zile mentionata mai sus. Endov va rambursa sumele reprezentand contravaloarea produsului nu mai tarziu de 14 zile de la data la care este informat cu privire la decizia de retragere din contract a cumparatorului, prin modalitatea de plata indicata de cumparator. Endov poate amana rambursarea sumelor pana la data receptionarii produselor care au facut obiectul vanzarii sau pana la momentul primirii unei dovezi din partea cumparatorului conform careia acesta a trimis produsele catre Endov, fiind valabila data cea mai apropiata.
8. Retur Produsele pot fi returnate in termen de 14 de zile calendaristice de la data primirii coletului. Produsele se returneaza impreuna cu FORMULARUL DE RETUR ce poate fi gasit in colet, alaturi de produsele livrate. In cazul in care nu ai un FORMULAR DE RETUR, te rugam sa mentionezi in coletul cu care returnezi produsul: datele de identificare (nume, prenume, adresa la care au fost livrate produsele, e-mail si numarul de telefon), lista cu produsele returnate, detalii privind modul de utilizare , felul in care se doreste returnarea (schimbarea sau returnarea contravalorii produselor) si detalii privind contul in care se doreste primirea banilor. Daca produsul nu se returneaza impreuna cu ambalajele si accesoriile originale, daca prezinta semne de uzura sau este deteriorat, sau daca nu este insotit de certificatul de garantie sau instructiuni, avem dreptul de a decide acceptarea returului sau de a opri o suma din valoarea acestuia, suma ce va fi comunicata cumparatorului dupa evaluarea prejudiciilor aduse. Nu rupe eticheta detasabila! Costurile de ambalare si livrare nu sunt incluse in sumele ce vor fi returnate. Adresa retur produse: str. Bodoc nr. 8, sector 4, Bucharest, Romania. Modalitate retur: prin posta sau curier la adresa de retur, costurile returului in cuantum de 30 de lei, fiind suportate de expeditor.
Dupa primirea coletului vom transmite un e- mail de confirmare. Cererile de retur vor fi solutionate in termen de 14 zile de la data primirii produsului. In cazul acceptarii solicitarii de retur, produsele vor fi inlocuite sau va fi returnata contravaloarea produselor. Cumparatorul poate primi detalii despre starea returului contactandu- ne la adresa de e-mail:

Nu suntem responsabili de utilizarea defectuoasa, care nu corespunde indicatiilor de pe ambalaj sau instructiunilor de utilizare. Pentru mai multe detalii despre produsele prezentate pe site, cumparatorul ne poate contacta.
9. Protectia datelor Endov, operatorul acestui magazin online, este inregistrat in Registrul de evidenta a prelucrarii datelor cu caracter personal al Autoritatii Nationale de Supraveghere a Prelucrarii Datelor cu Caracter Personal (ANSPDCP).
Prin crearea contului, cumparatorul isi exprima consimtamantul ca Endov sa colecteze si sa administreze datele cu caracter personal in conditiile Legii 677/2001.
Cumparatorul este obligat(a) sa furnizeze datele in conditiile in care doreste sa lanseze o comanda, acestea fiind necesare desfasurarii in bune conditii a livrarilor de produse comandate si a incasarii contravalorii acestora. Refuzul face imposibila desfasurarea livrarilor de produse. Informatiile inregistrate sunt destinate utilizarii de catre operator. Conform Legii nr. 677/2001, cumparatorul beneficiaza de dreptul de acces, de interventie asupra datelor, dreptul de a nu fi supus unei decizii individuale si dreptul de a se adresa justitiei. Totodata, cumparatorul are dreptul sa se opuna prelucrarii datelor personale care il privesc si sa solicite stergerea datelor. Pentru exercitarea acestor drepturi, acesta poate adresa o cerere scrisa, datata si semnata, transmisa catre Endov.
10. Cookies Site-ul foloseste cookie-uri (date IT stocate pe terminalul utilizatorului in scopul utilizarii paginii web). Aceste fisiere fac posibila recunoasterea terminalului utilizatorului si prezentarea continutului intr-un mod relevant, adaptat preferintelor utilizatorului. Neacceptarea unui cookie nu inseamna ca utilizatorului ii va fi refuzat accesul de navigare in site, de citire a continutului acestuia.
11. Confidentialitate Endov a luat toate masurile de securitate necesare pentru protejarea informatiilor personale ale utilizatorilor site-ului. Informatiile din formularul de comanda sau comunicate telefonic reprezentantului Endov vor fi folosite pentru a transmite cumparatorului confirmarea comenzilor, eventualele promotii, informari periodice, cu acordul acestuia prealabil.
12. Forta majora Endov are dreptul de a intarzia sau anula livrarea produselor, daca aceasta nu poate fi onorata din motive independente de Endov (cum ar fi: incendii, explozii, inundatii, conditii meteo extreme, greve, razboaie, acte de terorism, etc.). Daca in termen de 30 de zile de la data producerii lui, respectivul eveniment nu inceteaza, oricare dintre parti are dreptul de a notifica celeilalte parti incetarea de drept a contractului.
13. Litigii Orice litigiu aparut intre Endov si cumparator va fi rezolvat pe cale amiabila. In cazul in care acest lucru nu este posibil, litigiul va fi solutionat de instantele romane competente.
